1. Scope and Provider

(1) These terms apply to all contracts for the use of Zielor (the app for iPhone and iPad, the web app and related services) between you and

("we" or "us").

(2) Other terms only apply if we expressly agree to them.

(3) A consumer under these terms is any natural person who enters into the contract for purposes that are mainly outside their trade, business or profession (§ 13 BGB).

2. Services

(1) Zielor is a digital learning platform that prepares you for German language exams, currently the Deutsch-Test für Zuwanderer (DTZ), the Leben in Deutschland test, and Goethe and telc exams from A1 to B2. It includes in particular practice tasks in the exam format, a placement test, a study plan, timed mock exams, a readiness estimate and an AI examiner that grades written and spoken answers. Explanations and feedback are available in 12 languages; the exam content itself is in German.

(2) Every subscription includes all exams and levels we offer, on all supported devices, within the fair use limits in section 7.

(3) The exact features are those described in the app and on our website at the time of your order.

3. Not an Official Exam, No Guarantee

(1) Zielor is unofficial exam preparation. We are not affiliated with, reviewed by or endorsed by Goethe-Institut, telc gGmbH, g.a.s.t. or the Federal Office for Migration and Refugees (BAMF).

(2) We do not hold exams and do not issue certificates. You still need to register for the real exam at a test centre.

(3) All scores, level estimates, corrections and readiness statements are produced by an AI system and are estimates. They are not official exam results. The AI system can make mistakes. We do not guarantee that you will pass an exam or reach any particular result.

4. How the Contract Is Made

(1) Purchases in the app (Apple): when you subscribe in the iPhone or iPad app, you buy through the App Store. Apple is the contracting party for the purchase and payment, and Apple's Media Services Terms also apply. These terms govern your use of Zielor.

(2) Purchases on the web: the plans shown on our website are not a binding offer. You choose a plan, check your details and can correct any input errors before ordering. By clicking the button labelled "zahlungspflichtig bestellen" (order with obligation to pay) you make a binding offer. The contract is concluded when we confirm your order by email or activate your subscription, whichever comes first. Payment is handled by [missing: whopEntityName], which acts as merchant of record, collects the payment and remits VAT. Whop's terms also apply to the payment.

(3) The contract languages are German and English. We store the contract text and email you the contract details, these terms and the withdrawal instructions after your order.

5. Account and Minimum Age

(1) You need an account to use the service. You must be at least 18 years old.

(2) Your details must be true. Keep your login details secret. An account is personal and may not be shared.

(3) A subscription bought on the web also unlocks the app once you sign in with the same account.

6. Prices, Plans and Payment

(1) The following subscriptions are available:

(2) All prices are final prices including statutory VAT. In the App Store, the price shown there for your country applies.

(3) The price is payable in advance at the start of each billing period. For App Store purchases Apple collects it, for web purchases Whop, in each case using the payment method you saved there.

(4) Price changes for a running subscription only take effect if you agree to them. If you do not agree, either side may cancel the subscription at the end of the current billing period. For App Store purchases Apple asks for your consent under its own rules.

7. Fair Use

(1) Every subscription includes, per month, up to 40 writing grades, 20 graded speaking tasks and 3 full mock exams.

(2) A month is each period of one month from the start of your subscription. On the weekly plan, all weeks that fall into such a period count together. Unused grades expire at the end of the period.

(3) Once you reach a limit, you can keep using every other feature. New grades of that kind become available again in the next period. You can see your usage in the app under Account at any time.

(4) The limits are set to cover intensive exam preparation. They exist to share the cost of AI grading fairly.

8. Free Trial

(1) The Monthly, Quarterly and Yearly plans start with a free trial of 7 days. The Weekly plan has no trial.

(2) If you do not cancel before the trial ends, it turns automatically into the paid subscription you chose, and the first payment becomes due.

(3) Each person can have one trial only. For App Store purchases, Apple decides whether you are eligible for a trial.

9. Term, Renewal and Cancellation

(1) Renewal: a subscription renews automatically for the chosen billing period unless you cancel it beforehand.

(2) Reminder: we remind you by email or in-app notification at least 3 days before every renewal and before a trial ends.

(3) Weekly and Monthly: you can cancel at any time, effective at the end of the current billing period.

(4) Quarterly and Yearly: you can cancel at any time, effective at the end of the first term. For web purchases: after the first term the subscription continues for an indefinite period and is still billed in advance for the chosen period. You can then cancel at any time with one month's notice. We refund the part of the price already paid that covers the time after the contract ends.

(5) How to cancel in the App Store: in the settings of your Apple device, under your name, then Subscriptions. Apple requires you to cancel at least 24 hours before the current period ends.

(6) How to cancel on the web: use the button "Verträge hier kündigen" (cancel contracts here) at [missing: cancelUrl], go to Account in the web app, or write to contact@zielor.de. You do not need an account or password for this. We confirm the cancellation by email straight away.

(7) After cancelling, you can keep using Zielor until the end of the period you have paid for.

(8) Both sides keep the right to terminate for good cause. Good cause for us exists in particular in the event of a serious breach of section 11.

(9) Deleting your account does not end an App Store subscription. Please also cancel it with Apple.

10. Right of Withdrawal

As a consumer you have a statutory right of withdrawal. The details are in our withdrawal instructions. For App Store purchases, Apple's process applies.

11. Rules of Use

When using Zielor you may in particular not

• record or upload other people's voices without their consent,
• upload content that infringes the rights of others or is unlawful,
• systematically copy, publish or resell tasks, audio files or feedback,
• scrape the app or use it through scripts,
• try to manipulate the AI examiner, get around security measures or usage limits, or reverse engineer the software, unless the law expressly allows it,
• share your account with others.

12. Rights to Content

(1) All tasks, texts, audio files, images and the software of Zielor are protected by copyright. For the duration of your subscription you receive a simple, non-transferable right to use them for your personal exam preparation. This also applies to content you download for offline use.

(2) Your answers and recordings belong to you. You only grant us the rights we need to store, grade and show them to you. These rights end when you delete the content or your account. How we process your data is explained in our privacy policy.

13. Availability, Updates and Changes

(1) We aim to provide Zielor without interruption. Short interruptions for maintenance, security updates or due to faults outside our control cannot always be avoided.

(2) During the term we provide the updates needed to keep Zielor in line with the contract and secure (§ 327f BGB).

(3) We may change Zielor beyond what paragraph 2 requires if there is a valid reason, such as new exam formats, technical development, security or a change in the law, and it costs you nothing extra. We will inform you clearly about the change. If a change impairs your access or the usability more than only slightly, we will inform you in good time beforehand on a durable medium, and you may end the contract free of charge within 30 days of the information or the change, whichever is later (§ 327r BGB).

14. Warranty

The statutory rights for defects in digital products apply (§§ 327 et seq. BGB).

15. Liability

(1) We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the Product Liability Act, and where we have given a guarantee.

(2) For slight negligence we are only liable if we breach an essential contractual obligation. That is an obligation whose fulfilment makes the proper performance of the contract possible in the first place and on whose fulfilment you may regularly rely. In that case our liability is limited to the damage that was foreseeable and typical for this kind of contract when it was concluded.

(3) Otherwise our liability is excluded. This also applies to the personal liability of our employees, representatives and agents.

(4) As AI grades are estimates (section 3), we are not liable for an exam not turning out as estimated. Paragraphs 1 and 2 remain unaffected.

16. Changes to These Terms

Changes to these terms for running contracts only take effect with your consent. We send you the changed terms in good time beforehand. If you do not agree, your contract continues on the previous terms. We may then cancel it at the end of the current billing period.

17. Dispute Resolution

We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board. If you have a question or complaint, please write to us at contact@zielor.de.

18. Governing Law and Jurisdiction

(1) German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice of law only applies to the extent that it does not deprive you of the protection of the mandatory provisions of the law of the country where you have your habitual residence (Art. 6(2) Rome I Regulation).

(2) For consumers, the statutory places of jurisdiction apply.

19. Final Provisions

(1) If any provision of these terms is invalid, the rest of the contract remains valid. The statutory rule replaces the invalid provision.

(2) These terms are available in German and English. The German version prevails.
